USE OF THE ASSOCIATION’S INTERACTIVE ENTERTAINMENT SERVICES AND USE OF THIS WEBSITE CONSTITUTES AGREEMENT TO THE FOLLOWING TERMS OF SERVICE.
1.1 To the maximum extent permitted by Italian law, the following Terms of Service sets the general use of the Association’s interactive entertainment services and governs the conduct of the Association and its Members in the provision of these services.
1.2 The Association may revise the Terms of Service and the website and its contents at its sole discretion without prior notice.
“Association” refers to an Association board member, partners and affiliates, volunteers, employees, agents, licensors, suppliers, representatives and any other persons acting on behalf of the Association in a legal manner.
“Member” is a legal person who registers at the Association and pays a membership fee to have access to services provided by the Association.
“Escape Room” is a room or system of rooms at the venue where games are played.
“Game” is an interactive entertainment service provided by the Association in the interest of promoting social culture within the region. In the game participants are tasked with finding a way to escape the escape room by solving a series of lingual, visual, mathematical, spatial, physical and lateral puzzles.
“Participants” are persons who are interested in registering as a member of the Association or existing Members and who pay a fee to participate in services provided by the Association.
“Gamemaker” is a person who operates the venue and oversees the games.
“Rules” set the conditions for participation in Games.
“Game Fee” is the consideration paid to participate in games.
“User” is any person who visits, browses and interacts with the Association’s website.
3.1 Participants must register as a Member of the Association and pay the membership fee prior to participation in any Games. Members must be aged 12 and over.
3.2 Children aged 12-17 must register in the company of a parent or legal guardian. Preregistration, registration and waivers are to be completed and signed by the parent or legal guardian on behalf of the child.
3.3 Preregistration is available on the Association website but membership is not confirmed without a signed registration form and payment of the membership fee.
3.4 A valid document to prove identity and age is to be presented at registration, otherwise the Association may refuse membership.
3.6 Membership into the Association is for the duration of the current calendar year and is renewable annually.
3.7 Members grant the Association permission to send by email, SMS or social media, notifications and other information in relation to the Association.
3.8 Members may cancel their membership at any time for any reason by email or in person. Membership fees are not refundable.
3.9 It is the responsibility of Members to read and be informed of their rights as stated in the Association Statutes and Bylaws.
4.1 The Association provides interactive entertainment services in the form of live Escape Room Games whereby Participants find a way to escape a room or system of rooms within a set time. Participants escape by solving a series of lingual, visual, mathematical, spatial, physical and lateral puzzles. The Games may involve searching for objects, removing objects or modifying them to solve puzzles and eventually escape the room. During the Game, the Gamemaker monitors the Participants from outside the room to provide Game clues and hints.
4.2 The Association provides interactive entertainment services on an “as is” or “as available” basis. It does not warrant the reliability, accuracy, completeness, suitability, or timeliness of the Escape Rooms or Games.
4.3 There are potential risks in accessing the Escape Rooms and participating in Games, including risks that have not been identified through the reasonable efforts of the Association. The Association advises that the Escape Rooms or Games may be dangerous, hazardous, risky, unsafe or insecure particularly to people with heart problems, epilepsy or severe claustrophobia. Participants must sign a waiver and release of liability before participating in any Games.
4.4 Dangerous, harmful or hazardous objects including but not limited to sharp objects, explosive items or weapons deemed dangerous or harmful to others; and drugs or alcohol are completely prohibited from the Venue. The Association may decline or refuse entry to those who have drugs or alcohol in their possession or are under the influence of drugs or alcohol.
4.5 To provide Participants with the best possible gaming experience, all personal belongings including but not limited to bags, mobile phones, wallets, other items and/or property, are strictly not permitted in the Escape Rooms. Participants may store personal items in a locked place at the Venue and take the key into the Escape Room.
5.1 Participation in Games is by appointment only. Bookings can be made on the Association website, by email, phone or in person, only by someone aged 18 and over.
5.2 Online bookings can be made four (4) hours before the preferred Game start time. Confirmations of online bookings are sent by email and/or SMS only. Participants who do not receive a confirmation within 1 hour of booking must contact the Association by phone. Before calling, the SPAM folder should be checked for email confirmation.
5.3 Game Fees are set per Game regardless of the number of Participants. The Association may use the fees to cover the periodic expenses of the Association, general maintenance of the Escape Rooms, events and the addition of new services, Escape Rooms or Games.
5.4 Participants warrant to the Association that all details on the online booking and preregistration forms are true and accurate.
6.1 To cancel or postpone a booking, the Association must be contacted by email or in person.
6.2 The Association reserves the right to cancel or postpone a Game for any unforeseen circumstance in which case, the Association will notify the Participant as soon as possible.
7.1 PARTICIPANTS RELEASE THE ASSOCIATION, ITS BOARD MEMBERS, PARTNERS AND AFFILIATES, VOLUNTEERS, EMPLOYEES, AGENTS, LICENSORS, SUPPLIERS, REPRESENTATIVES AND ANY OTHER PERSONS ACTING ON BEHALF OF THE ASSOCIATION, OF ALL LIABILITIES ARISING OUT OF THE USE OF ITS INTERACTIVE ENTERTAINMENT SERVICES, EXCEPT WHERE THE LOSS OR DAMAGE WAS DUE TO GROSS NEGLIGENCE OR WILLFUL MISCONDUCT BY THE ASSOCIATION.
8.1 TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE ASSOCIATION, ITS BOARD MEMBERS, PARTNERS AND AFFILIATES, VOLUNTEERS, EMPLOYEES, AGENTS, LICENSORS, SUPPLIERS, REPRESENTATIVES AND ANY OTHER PERSONS ACTING ON BEHALF OF THE ASSOCIATION, WILL NOT BE LIABLE FOR ANY LOSSES AND/OR DAMAGES, OF ANY NATURE, RESULTING FROM THE USE OF ITS INTERACTIVE ENTERTAINMENT SERVICES EXCEPT WHERE THE LOSS OR DAMAGE WAS DUE TO GROSS NEGLIGENCE OR WILLFUL MISCONDUCT BY THE ASSOCIATION.
9.1 During the use of its services, the Association may disclose to Participants, or they may otherwise learn of or discover, trade secrets such as Escape Room and Game information, and full or partial Game solutions; Association documentation; know-how or other aspects of the Association’s organisation. Participants agree and acknowledge that such information is confidential and is the Association’s sole and exclusive intellectual property. Any publication or disclosure of this information to a third party is strictly prohibited and will be challenged in a court of law.
9.2 Participants may not record, capture or snap any photograph, video or audio recording whatsoever at the Venue without the explicit permission of the Association. Such recordings are the intellectual property of the Association and therefore any offenders will be subject to penalties provided by the appropriate laws.
10.1 Members who send both solicited and unsolicited suggestions, ideas, proposals or comments to improve the Association’s services, facilities or website agree that submissions and their contents will automatically become the property of the Association without any compensation to the Member.
11.1 The website at www.reddoorescape.it is owned and operated by the Association.
11.2 This website is provided on an “as is” or “as available” basis and the Association makes no representations or warranties of any kind, as to the reliability, accuracy, completeness, suitability, or timeliness of the information and materials found or offered on this website.
11.3 Users agree that the website may include materials and information protected by copyright, trademarks, patents, trade secrets, or other proprietary rights and laws. Users may not copy, reproduce, publish, download, post, broadcast, transmit or distribute or otherwise use in any medium and in any form the information and the material on this website without the written permission of the Association. Any unauthorized use of the information and the material is a violation of copyright and other intellectual proprietary rights of the Association and/or third parties.
11.4 Users acknowledge and accept that navigation of the website is at the absolute discretion and sole risk of the User. Users will be responsible for any loss and/or damage to their computer, hardware or software, or loss of data or data confidentiality resulting from use of the website or third party websites linked to the website.
